We will take action against anyone responsible for causing problems to other residents, our employees or contractors. We take all your complaints about Anti-Social Behaviour (ASB) very seriously as most of you want to live in peace and quiet.
However, we will get tough if we need to be.
Injunctions with power of arrest
In February a County Court awarded us injunctions with the power of arrest against a resident and their visitor, for causing a noise-nuisance and threatening their neighbours. If either of them breach the injunction they can be arrested and will have to appear in court the next day.
The injunctions are in force for one year.
The tenant can no longer cause a nuisance to the neighbours, contact their neighbour for any reason and cannot swear or use abusive language in the property so that it can be heard from outside.
The visitor cannot visit the property anymore, cause a nuisance to neighbours or contact any neighbours.
Starter Tenancies
All residents who have their first property with us are on starter-tenancies for 12 months. This means that if there are issues in that first year we will take further action.
We have taken back the homes of five tenants who were on starter tenancies and caused Anti-Social Behaviour that included, noise-nuisance, threatening behaviour and drug use.
Evictions and suspended Possession Orders
Residents can be evicted from their homes no matter how long they have been living in a Swan property if they are found to be the cause of serious ongoing Anti-Social Behaviour. We can apply for a Possession Order before a judge at the County Court and if successful evict the resident.
In some cases a suspended Possession Order is granted on the condition that the resident does not do certain things, for example, play loud music.
We have taken a number of residents to court for causing Anti-Social Behaviour and have obtained two suspended Possession Orders.
If the tenants cause further nuisance, we will apply to court for them to be evicted.
Cannabis cultivation and drugs
Police inform us if any of our residents have been caught growing cannabis or are involved in drug use in our homes or on our property. Those residents risk being evicted from their homes.
We take this matter very seriously and have recently taken legal action against four residents involved with drugs and growing cannabis in their homes.
If you suspect drug use or the growing of drugs on one of our properties please inform the Police and contact your Neighbourhood Officer.
